Civil Partnership Registration
The Civil Partnership Act 2004 was implemented on 5th December 2005.
Same-sex couples are able to make a formal, legal commitment to each other by registering their civil partnership under this Act.
A couple who register a civil partnership will acquire the new legal status of 'civil partner'.
On registering a civil partnership a couple will thereby acquire similar rights and responsibilities to those of a married couple such as employment and pension benefits and recognition under intestacy rules.
Civil partners must be:
- 16 years of age or over
- of the same gender
- not currently married
- not currently in a civil partnership
- not related to each other within the prohibited degrees of relationship
A couple will need to give notice of their intention to register a civil partnership. There will then be a minimum waiting period of 15 days during which details contained in the notice will be publicised. The civil partnership schedule will be issued after the waiting period has finished. The civil partnership can then be registered at a register office or any premises approved for the registration of civil partnerships.
The civil partnership is registered when the couple sign the civil partnership schedule in the presence of a civil partnership registrar and two witnesses. The civil partnership is recorded in the Civil Partnership Register usually within the week following the registration of the partnership, after which civil partnership certificates will be available.
No religious service can be used at the registration of a civil partnership which takes place at a Register Office or in Approved Premises.
It is possible to register a civil partnership in a Church or other religious building provided that the religious building has already been approved for the registration of civil partnerships.
No ceremony is required by law, however a simple ceremony can take place at the Register Office or one of the Approved Premises in Birmingham. If a couple wish only to register by signing the schedules in the presence of two witnesses and a civil partnership registrar, that can be arranged.
