Regulatory Services Enforcement Policy

The Regulation and Enforcement Division of Birmingham City Council consists of a variety of service areas; each one has significant responsibility for enforcing criminal and civil legislation relevant to its area of work.

The Legislative and Regulatory Reform Act 2006 requires us to publish an Enforcement Policy which we review annually. The policy commits Regulation and Enforcement to good enforcement practice and describes what businesses, or indeed anyone, can expect in terms of when and how our officers take legal action.

The service areas that are particularly affected by the policy are:-

Licensing

Private Rented Sector (Landlords) - Houses in Multiple Occupation

One area that the Licensing and Public Protection Committee has already asked us to consider is how we decide whether to prosecute or caution offenders for the sale of age restricted products to minors.

A consultation on the current enforcement policy closed on 18 February and a revised policy will be considered by the Licensing and Public Protection Committee at their meeting on 20 March 2013.

On request the enforcement policy can be made available on tape, in braille or large type.
