Traders Prosecuted Food Offences

This is a list of traders, prosecuted in Birmingham, that have been taken to court during the period August 2012 - February 2013.

Ferdost Khan
Pleaded guilty at Birmingham Magistrates Court on 9th August 2012 to 16 offences relating to the poor conditions at Khan Palace, 368 Stratford Road, Birmingham. Nine offences related to a visit on 5th September 2011. There was mouse activity throughout the premises and mouse droppings were found on lids used to cover foods. The kitchen walls were dirty and chicken leg bones were found on the floor. The surface of the gas cooker was greasy and dirty. A dirty pillow case was being used to handle foods being cooked in the tandoori oven. There was no hot water provided to the wash hand basins. Seven offences
relate to a further visit on 20th February 2012. The premises and equipment were still dirty and mouse droppings were found on packaging. Kebab skewers were dirty and a bag of raw meat was being stored above cooked rice.

Food World (Birmingham) Ltd
Pleaded guilty at Birmingham Magistrates Court on 9th August 2012 to two offences relating to the conditions at Food World (Birmingham) Ltd, 649-655 Washwood Heath Road. Mouse droppings were found throughout the rice shelving area, on shelves, floors and bags of rice. Floor surfaces underneath the shelving in the aisle were dirty with an accumulation of dirt and food debris.

Jahangir Chughtai
Pleaded guilty at Birmingham Magistrates Court on 23rd August 2012 to seven offences relating to the poor conditions at King Grill, 444 Park Road. There was evidence of mice throughout the premises with holes and gaps allowing access to pests. Mouse droppings were found in the servery and preparation area. Work surfaces and floor/wall junctions were dirty with food debris. Mouse droppings were found on a tub of chilli seeds and on take out bags. The potato chipper and dough mixer were dirty. A plastic bag containing herbs had been gnawed. Sentence £5,250 (£750 x 7)

Mohammed Abid Ayub
Pleaded guilty at Birmingham Magistrates Court on 23rd August 2012 to eight offences; six relating to the poor conditions at Mirchi Restaurant, 137 Soho Road, Birmingham. There were mouse droppings throughout the premises and a live mouse and cockroach on a sticky board. The premises, equipment, food processors and microwaves were in a dirty condition. The door to the cellar was not adequately pest proofed allowing the ingress of pests. There were no procedures in place based on HACCP. Two offences relate to the failure to comply with Hygiene Emergency Improvement Notices requiring them to ensure
that all food handlers received appropriate training and to implement a permanent procedure based on HACCP.

Andrew Arthur Allen
Pleaded guilty at Birmingham Magistrates Court on 30th August 2012 to eight offences relating to conditions at Andy Allen Foods, Unit 38, Mount Street Business Centre. The floor, sink units, preparation and storage tables in the preparation area were dirty. The dripping filling machine and gelatine filling machine were in a filthy condition. The gelatine boiler was in a dirty condition. Roller towels were being stored on the dirty floor of the storage area. Food handlers producing high risk ready-to-eat foods had not received food hygiene training. There were no procedures based on HACCP.

Orlando Cruz Banag
Pleaded guilty at Birmingham Magistrates Court to nine offences: one relating to the failure to produce transfer notes and descriptions of all commercial waste transferred from Orly’s Catering Services, 402 Flaxley Road and one of failing to keep food at the correct temperature. Raw meat was being stored in a freezer which had been switched off. Seven offences related to the conditions found at the premises. Food was being stored in a gazebo which was not fully enclosed in a garden where there was evidence of rat activity. There were rat droppings, cat excrement and cat hairs under the gazebo and inside the storeroom. Floors under the gazebo were filthy with an accumulation of grease, debris and dirt. A rice cooker, chopping board, food blender and meat slicer were found to be greasy. Food was not protected against contamination as grapes and oranges were stored inside a fridge on the same shelves as raw meat. Pork was found drying on a van roof.

Mohammed Umar Mangaa
Pleaded guilty at Birmingham Magistrates Court on 6th September 2012 to three offences relating to conditions at Pamir General Store, 620 Washwood Heath Road. Mouse droppings were littered throughout the premises, including the rear storeroom, retail area and on shelves where packaged foods were being stored. Food during distribution was not protected against contamination in that mouse droppings were found adhered to the packaging of cakes and biscuits. Packaging had been gnawed and holes in the structure allowed the ingress of mice.

Mohammed Mustafa
Pleaded guilty at Birmingham Magistrates Court on 13th September 2012 to seven offences relating to the poor conditions at Banu Indian Restaurant, 353 Hagley Road, Birmingham. The premises was not kept clean, the floor/wall junction in the kitchen was filthy, touch points throughout were dirty and the wash hand basin in the kitchen was dirty. Fittings and equipment which food comes into contact with were not effectively cleaned, the interior of the fridge was dirty, knives, spatulas and other food utensils were in a dirty condition and being stored in a dirty box and food containers throughout were dirty. Food was not
protected against contamination as bags of onions and potatoes were being stored outside in the yard which was dirty. Open containers of salad and cooked chicken were being stored on a dirty preparation table. Food handlers had not received food hygiene training and they were not wearing clean protective clothing when handling and preparing food. There were no procedures in place based on HACCP.

Mohammed Basit Butt
Pleaded guilty at Birmingham Magistrates Court on 4th October 2012 to 15 offences: 12 relating to the insanitary conditions at Yaadgar Kebab House, 122 Ladypool Road during five separate inspections. The premises were in a dirty
condition, work surfaces, fridges, freezers and basins were filthy. Ready prepared food was stored next to uncovered raw meat. Staff had not received sufficient training nor did they understand basic food hygiene or food
safety. There were accumulations of dirt and grease at floor/wall junctions and behind gas pipes in the upstairs preparation kitchen and in the servery. Mr Butt also failed to comply with three notices, a food hygiene Improvement
Notice, a Prohibition Notice prohibiting the use of the Tandoori clay oven and charcoal gas grill and an Improvement Notice requiring a number of appliances at the premises to be maintained in a safe condition. A Prohibition Order
was granted at Court prohibiting Mr Butt from participating in the management of any food business indefinitely.

Teck Young

Pleaded not guilty at Birmingham Magistrates Court on 10th October 2012 to seven offences relating to the poor conditions at BBQ Village, 51 Station Road, Birmingham. No adequate procedures were in place to control pests.
Mouse droppings were found throughout the premises and on metal serving dishes. There was a gap under the roller shutter doors to the storage area which was sufficient to allow access to pests. There was a build up of dirt and
grease along wall/floor junctions and under the cooker. Ingredients were not stored in appropriate conditions to protect them from contamination, melons had been gnawed by mice and open pots of ingredients were stored next to
mouse droppings. Found guilty after trial. A Prohibition Order was granted at Court prohibiting Mr Young from operating in the management of any food business until October 2017.

Songan Lei
Pleaded guilty at Birmingham Magistrates Court on 11th October 2012 to three offences relating to the poor conditions at Lucky Rainbow, Unit 7, Fox and Goose Shopping Centre, Washwood Heath. There were no procedures in place to control pests, mouse droppings were found throughout the kitchen, on the floor, in food containers, next to sauces and on pipework. There was a hole in the bottom of the rear external door and a hole around the gas pipe entry which could allow access to mice. Food debris on floor surfaces and large accumulations of grease provided mice with a good food supply.

Pleaded guilty at Birmingham Magistrates Court on 25th October 2012 to two offences relating to conditions at Maharaja, 23-25 Hurst Street, Birmingham. There was evidence of cockroach activity within the premises and surfaces
and equipment were littered with cockroaches, food debris and dirt.

Malik Mohmmede
Pleaded guilty at Birmingham Magistrates Court on 22nd November 2012 to nine offences: seven relating to the insanitary condition of Raheem Balti, 1481 Pershore Road. The business had not been registered with the City
Council, staff handling food were wearing their own clothes with no suitable over clothing. Food was not protected against contamination as it was stored in carrier bags. The microwave and fridges were dirty, chopping boards were
not clean and heavily scored. The walls were not clean with bare plaster exposed and Staff had not received any food hygiene training. The two remaining offences relate to the failure to ensure that the Shaan Tandoor oven was maintained in a safe condition and the failure to comply with a notice requiring copy documents to be provided relating to commercial waste transferred from the premises. Sentence 12 month community order with 12 months supervision & 200 hours unpaid work

Pleaded not guilty at Birmingham Magistrates Court on 26th November 2012 to three offences relating to the insanitary condition of Masters Catering, 38 Victoria Road, Birmingham. There was evidence of mouse activity throughout the ground floor of the premises and there were holes and gaps throughout the premises allowing access to pests. Mouse droppings were found on the preparation table, on shelving and floors and on food trays. Found
guilty after trial.

Pleaded guilty at Birmingham Magistrates Court on 30th November 2012 to 11 offences relating to the poor conditions at Punjab Kebab House, 403 Dudley Road, on four separate occasions. No soap or materials for cleaning hands were
provided; staff were not wearing suitable clean over clothing and were seen washing their hands without the use of soap. Articles, fittings and equipment were not effectively cleaned. There were no procedures based on HACCP.

properly, mouse droppings were found on equipment used for food, on chopping boards, in food containers and on utensils. There was evidence of mouse activity throughout the premises as gnawed bags of food were found. Floor surfaces underneath equipment in the kitchen were filthy with an accumulation of dirt and food debris.

Pleaded guilty at Birmingham Magistrates Court on 31st January 2013 to 3 offences relating to the insanitary condition of Aniqa’s Superstore, 64 Victoria Road, Aston, Birmingham, mouse droppings were found throughout the
retail area of the food business including on a table holding open fruit and vegetables. Mouse droppings, mouse urine, grease and gnawed cardboard were found on the floor under boxes of crisps. A gnawed packet of noodles was
found on a shelf and rat droppings were found in the two rear storerooms. There was a large gap underneath the rear shutter door allowing pests to enter the premises.

Pleaded guilty at Birmingham Magistrates Court on 31st January 2013 to 9 offences relating to the insanitary condition of Mugran Alnilain Restaurant, 82 Stratford Road, Birmingham, a muddy bicycle was stored in the kitchen
and dirty cardboard was lining the floor. There were no appropriate had drying facilities in the kitchen area and mouse droppings were found in boxes holding open food. The premises had not been registered with the City Council
and there was no documented food safety management system based on the HACCP principles in use at the premises. Staff members had not received any formal food training and there was no adequate system of pest control within
the premises.

Pleaded guilty at Birmingham Magistrates Court on 6th February 2013 to five offences relating to the poor conditions at Divine African Caribbean Restaurant, 325 Soho Road. The premises were not kept clean or maintained
in good condition. Tiles were missing from the kitchen wall and there was a hole in the wall. The extraction system, microwave, ceiling, kitchen floor and walls were dirty. There was no supply of hot water to the sinks or soap at the hand wash basin. Food was not protected against contamination as food was stored in open tins and carrier bags. There were no procedures in place based on HACCP. There was also no evidence that a maintenance inspection had been carried out or that the conversion from natural gas to liquid petroleum had been carried out by a competent person.

Lim Chee Wah
Pleaded guilty at Birmingham Magistrates Court on 21st February 2013 to four offences relating to the poor conditions at Little Kitchen, 529 Moseley Road. There was evidence of mouse activity at the premises. Raw materials were not protected against contamination as there was an open container of cooked rice adjacent to mouse droppings. Raw meat was found defrosting directly next to cooked meat. The premises were dirty and there was an accumulation of mouse droppings throughout the premises. Kitchen walls and cupboards were dirty
and there were holes in the premises that could allow access to pests. There were no procedures based on HACCP.
